1. Acceptance of Terms
Welcome to Flowtropy. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services") provided by BuildTeam Inc. ("Flowtropy," "we," "our," or "us").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age to create a studio account
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our Services under applicable law
- Use the Services only for lawful purposes and in accordance with these Terms
2.1 Member App Access
Studio members of any age may use the Flowtropy app for booking classes and managing their account, subject to any studio-specific policies.
2.2 Community Features
Community features (channels, posts, comments, reactions) require users to be at least 16 years of age due to user-generated content regulations. Users under 16 will have community features disabled until they reach this age.
3. Account Registration
3.1 Account Creation
To access certain features of our Services, you must create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.2 Account Security
You are responsible for safeguarding your account credentials. We recommend using a strong, unique password. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
4. Subscription and Payments
4.1 Subscription Plans
We offer various subscription plans with different features and pricing. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice.
4.2 Free Trial
We offer a 14-day free trial for new users. No credit card is required to start your trial. At the end of your trial, you may choose to subscribe or your account may be downgraded to limited access unless you subscribe.
4.3 Billing
Subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorize us and our payment processor to charge your payment method for all fees, taxes, and other charges due under your plan. Unless otherwise stated at checkout or in a written order form, paid subscriptions renew automatically for successive billing periods until canceled.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period unless otherwise stated in your plan or required by law. We do not provide refunds or credits for partial billing periods unless required by law or expressly stated in writing.
4.5 Refunds
Except as required by law, described in a plan-specific offer, or agreed in writing, subscription fees are non-refundable once charged.
If you believe a billing error has occurred, please contact us through our contact form before initiating a charge dispute so we can review and attempt to resolve the issue.
5. Acceptable Use
You agree not to use our Services to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful code, spam, or malware
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt our Services
- Collect user information without consent
- Impersonate any person or entity
- Use our Services for any fraudulent purpose
- Resell or redistribute our Services without permission
6. Your Content
6.1 Ownership
You retain ownership of all content you submit to our Services ("Your Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display Your Content solely to provide our Services to you.
6.2 Responsibility
You are solely responsible for Your Content. You represent and warrant that you have all necessary rights to submit Your Content and that it does not violate any laws or infringe any third-party rights.
7. Our Intellectual Property
Our Services, including all content, features, and functionality, are owned byFlowtropy and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works
- Reverse engineer or attempt to extract source code
- Remove any proprietary notices
- Use our trademarks without permission

9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be uninterrupted or error-free
- Warranties regarding the accuracy of any information
- Warranties that defects will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWTROPY SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Any damages exceeding the amount paid by you in the past 12 months
Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Flowtropy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal dispute, you agree to first contact us through our contact form to attempt to resolve the dispute informally.
12.2 Governing Law
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
12.3 Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or other urgent matters.
Unless applicable law requires otherwise, the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute or claim arising out of or relating to these Terms or the Services, and each party consents to those courts.
13. Termination
We may suspend or terminate your access to our Services at any time for any reason, including violation of these Terms. Upon termination:
- Your right to use the Services will immediately cease
- You may export your data within 30 days
- Provisions that should survive termination will remain in effect
14. Account Deletion
You may request deletion of your account and associated data at any time by contacting us through our contact form. Upon receiving your request, we will delete your personal information within 30 days. Certain data may be retained as required by law (e.g., transaction records for tax and accounting purposes).
15. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through our Services at least 30 days in advance. Continued use of our Services after changes take effect constitutes acceptance of the modified Terms.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Flowtropy.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our prior written consent.
